TERMS AND CONDITIONS for Upholstery and Cleaning Services

§1. SERVICE PROVIDER INFORMATION The service provider is: [Kostiantyn Kalymaha], with a registered office at [Niebyla 11], NIP: [6783219432], REGON: [529420729], registered in CEIDG/KRS, hereinafter referred to as the “Service Provider.”

§2. DEFINITIONS Client – a natural or legal person who has placed an order for a service. Service – cleaning of furniture upholstery, car interiors, carpets, and rugs. Regulations – this document governing cooperation between the Client and the Service Provider.

§3. WHO CAN BE A CLIENT A Client can be:

  • a natural person over the age of 18 with full legal capacity,

  • a legal person,

  • an organizational unit without legal personality,

  • a business with a NIP and REGON number.

The Service Provider reserves the right to refuse service to:

  • minors,

  • persons under the influence of alcohol or intoxicants,

  • individuals behaving aggressively or posing a threat to staff.

By placing an order, the Client declares that they:

  • are the owner of the item to be serviced (e.g., furniture, car, carpet), or

  • have the owner’s consent to perform the service.

§4. ACCEPTANCE OF TERMS Placing an order via phone, SMS, OLX, Facebook, Messenger, Fixly, Oferteo, etc., implies acknowledgment and acceptance of these Terms and Conditions. These Terms apply regardless of whether the agreement is verbal, written, or electronic.

§5. SERVICE EXECUTION RULES The Client is required to provide accurate and complete information regarding the item to be cleaned (e.g., material type, degree of soiling, visible damages, previous cleaning attempts).

The Service Provider reserves the right to refuse service if:

  • the item’s condition poses a risk to staff or equipment,

  • the material is unsuitable for cleaning with the available means.

Before starting the service, the Client receives verbal information about:

  • estimated completion time,

  • cleaning method used,

  • potential risks (e.g., discoloration, deformation, persistent stains).

§6. POSSIBLE DAMAGES AND LIABILITY The Service Provider undertakes all efforts to perform the service professionally and safely. However, they are not liable for:

  • damages resulting from pre-existing, hidden material defects (e.g., abrasions, micro-cracks, invisible stains before cleaning),

  • stains that cannot be removed despite using professional agents,

  • discoloration or color changes due to chemical reactions,

  • deformations of glued carpets and rugs,

  • detachment of upholstery or headliners,

  • previous failed cleaning attempts by others,

  • damage to walls, baseboards, floors, curtains, furniture, or surroundings.

The Client acknowledges that the cleaning process may:

  • reveal previously invisible defects,

  • exacerbate existing damage.

If damage is caused by the Service Provider’s clear fault, the Client may file a complaint in accordance with §8.

§7. PAYMENT TERMS Payment is due immediately after service completion via cash, bank transfer, or another agreed method. The minimum order value for mobile service is PLN 200.

§8. COMPLAINTS Complaints must be submitted within 7 business days from the service date. They can be submitted via:

Complaints will be reviewed within 31 business days. Complaints will not be accepted if:

  • the Client did not inform about specific material characteristics in writing before the service,

  • prior damages or cleanings were hidden,

  • the item was unsuitable for cleaning,

  • the claim lacks evidence (e.g., photos).

Arguments such as:

  • “I wasn’t informed,”

  • “I missed it in the Terms,”

  • “I was told otherwise” will not be accepted if the information is provided here or communicated orally/in writing.

Complaint resolution options:

  • free re-cleaning (max. 3 times),

  • partial/full refund (at the discretion of the Service Provider),

  • other actions agreed in writing.

§9. FINAL PROVISIONS The Service Provider may refuse service if there’s a risk of material damage or safety violation. The Client acknowledges that after the service, upholstery, rugs, or carpets may remain damp and require 1–20 hours to dry naturally. The Service Provider reserves the right to modify these Terms at any time. The new version takes effect upon publication. For matters not covered herein, the Civil Code applies. All disputes will be settled by the court competent for the Service Provider’s registered office.

§10. ADDITIONAL PROVISIONS

  • Upholstery cleaning services are performed only at the location specified by the Client. The company does not operate a service facility; all services are mobile.

  • The company operates within Krakow and surrounding areas.

  • Travel within Krakow is free of charge. Travel to other locations is priced individually.

  • The Client is responsible for preparing furniture by:

    • emptying bedding compartments,

    • removing dirt, sand, crumbs, etc. around and under the furniture to prevent scratching the floor.

  • The company does not guarantee removal of all stains, especially those from:

    • blood, urine, coffee, tea, ink, grease, etc.,

    • particularly if old or previously treated with home methods or unsuitable chemicals.

  • The company does not guarantee complete removal of unpleasant odors such as:

    • urine, vomit, organic smells, and other strong odors.

  • Upholstered furniture is cleaned only in areas accessible to the extractor nozzle – lack of access may result in skipping parts of the furniture.

  • During service execution, the company takes photo and video documentation to:

    • confirm the condition of furniture before and after cleaning,

    • record the scope of work performed.

  • The company reserves the right to use photos and videos for promotional purposes while respecting the Client’s privacy and image rights.

  • Placing an order constitutes acceptance of these Terms and Conditions.

  • The service price list is available on the company’s website under the “Cennik” tab and is indicative.

  • Each cleaning item is priced individually – the price is determined verbally or in writing with the Client before service commencement.

  • By ordering a service, the Client assumes responsibility for any damage resulting from:

    • natural wear and tear,

    • hidden defects or material weakness,

    • prior damage,

    • future misuse of the item.

  • The company will make every effort to minimize the risk of damage but is not liable for issues arising from the above causes.
